Should I wait for the criminal DUI case to resolve before filing my civil claim?
No. Civil and criminal proceedings are independent. You should file your civil claim promptly — the 2-year statute of limitations runs from the date of the accident regardless of the criminal case status. A criminal conviction is powerful evidence in your civil case, but a criminal acquittal does not bar your civil claim (the standards of proof are different).
