UCLA Law Trained Attorneys in Camarillo

A wrongful death claim in California is not about punishment. It is about holding negligent parties accountable and securing the compensation your family needs to move forward. CCP Section 377.60 allows surviving spouses, domestic partners, children, and dependents to file the claim. The estate can pursue a separate survival action under Section 377.30 for damages suffered before death, including pain and medical costs.

Camarillo has a mix of agricultural industry, commercial corridors, and residential neighborhoods, and wrongful death cases here reflect that range. Curt files at Ventura County Superior Court, where he has experience with local judges and juries. He works directly with families from the first meeting and does not hand cases off to junior associates. Your family deserves that level of attention right now.

A local attorney, not a remote firm

Deep Ventura County Roots

I grew up in Thousand Oaks, at the eastern edge of Ventura County. I've represented injured residents throughout the 101 corridor and know what it takes to build a strong case for someone hurt on Pleasant Valley Road or the US-101 through Camarillo. Money Pauncho is my favorite restaurant out here: get the burrito grande and ceviche. Institution Ale Co. for pizza. I handle every Ventura County case personally, not a paralegal, not a junior associate.

Agricultural Roads, Freeway Corridors, and Ventura County Courts

Camarillo's crash mix is different from its Conejo Valley neighbors. Commercial trucks, farm equipment, and a high-speed 101 corridor all factor in. Here is the local and legal context that applies to your case.

Where you go after a serious crash

Paramedics route to Los Robles Regional (Level II Trauma, Thousand Oaks) or Ventura County Medical Center (Level II, City of Ventura). St. John's Regional in Oxnard is closer but not a trauma center. Critical cases go to UCLA Ronald Reagan (Level I).

California Wrongful Death Statute — CCP §377.60

California law allows surviving spouses, children, and — in some cases — other dependents to file a civil wrongful death claim for the negligent, reckless, or intentional killing of a family member. This is a separate claim from any criminal prosecution.

Survival actions run alongside wrongful death

A survival action (CCP §377.30) allows the estate to recover damages the deceased could have claimed if they had survived — including pain and suffering experienced before death. Both claims can run simultaneously and are often pursued together.

Before you call anyone

Most Firms Will Take Your Case.
Few Will Actually Fight For It.

From the moment a claim is filed, the other side is building a case against yours. Adjusters document inconsistencies, make early offers designed to be accepted, and count on injured people to take less than they deserve. Most personal injury firms respond by loading up their docket: you get assigned to a paralegal, your calls go unanswered, and your case settles fast because the firm needs to move on.

We built L&F Brown differently.

  • You talk to a founding partner. Not intake staff, not a junior associate. A UCLA Law-trained senior attorney who handles your case personally from first call to resolution.
  • We limit our caseload on purpose. More cases means less attention. We take fewer so every client gets the time and resources their case actually requires.
  • We don't settle until the number is right. Insurance companies know which firms fold early. We're not one of them, and they know it.

Evidence fades. Deadlines are real. The sooner you have an attorney building your case, the better your position. This is our personal commitment to every client we take on.

What Makes Your Injury Case Different

Camarillo Premium Outlets draws visitors from across Southern California. A lot of people who get hurt there do not live in Ventura County. That creates insurance and jurisdiction wrinkles that need to be sorted out early. The Outlets are also owned by a national REIT with a professional claims operation that fights every slip and fall.

Active farming on Pleasant Valley Road and Lewis Road puts slow-moving tractors and equipment on roads where cars are doing 55. Road debris from agricultural operations and deferred county maintenance on these stretches can create liability for the farm operator, the equipment company, or the county itself. You do not see this in most cities.

The US-101 interchanges at Las Posas Road and Daily Drive carry heavy commercial truck traffic. When a truck is involved, there is a whole separate set of federal safety regulations that may have been violated. That opens claims against the trucking company and its insurer, not just the driver.

Everything files in Ventura County Superior Court in the City of Ventura. We know the judges and we know what Ventura County juries expect.

Dangerous corridors

Where the Crashes Happen

Local road patterns determine what evidence we seek, which defendants we name, and how we frame fault. These are the corridors in Camarillo where crashes concentrate.

  • high
    US-101 (Las Posas Road interchange)

One of the busiest interchange points in Ventura County. Heavy commercial vehicle traffic accessing industrial parks and outlet center-bound shoppers create dangerous merge conditions year-round.

  • high
    Las Posas Road

Principal north-south arterial through Camarillo. High-volume mixed residential and commercial traffic with documented intersection conflicts at major cross streets.

  • moderate
    Pleasant Valley Road

East-west arterial through Camarillo's agricultural and residential areas. Speed differentials and limited sight lines at rural intersections contribute to serious injury crashes.

  • high
    Daily Drive (near Outlets)

High-pedestrian commercial corridor near the Camarillo Premium Outlets. Parking lot collisions, pedestrian crossings, and congestion during peak shopping periods create significant crash risk.

  • moderate
    Ventura Boulevard (Camarillo section)

Historic commercial corridor through old town Camarillo. Mixed-use development with pedestrian activity, bicycle traffic, and delivery vehicles creates ongoing conflict with through traffic.

The Crashes That Define This Area

The Las Posas Road interchange on the 101 is the highest-volume collision point in Camarillo. Commuter traffic, commercial trucks, and outlet-bound visitors all converge, and the merge geometry produces a predictable pattern of rear-end and sideswipe crashes.

Pleasant Valley Road is where the agricultural road crashes happen: a car closing on a tractor at 55 mph with no time to stop, debris from a harvesting operation puncturing a tire and causing a rollover. Daily Drive gets the commercial and commuter mix. Las Posas Road is the interchange feeder with its own set of high-speed merge collisions. Ventura Boulevard through old town carries the pedestrian and local traffic.

A recent Camarillo case involved a visitor from San Diego who slipped at the Premium Outlets on a wet surface the property had been warned about. Another was a collision on Pleasant Valley Road between a sedan and a piece of farm equipment that had no reflective markers. A third was a commercial truck rear-end on the 101 where the driver had exceeded federal hours-of-service limits. Three completely different defendants, three different bodies of law.

What you can recover

Compensation Available in Your Case

A wrongful death claim accounts for the full financial and personal toll on your family. California law is specific about what is recoverable. Here is the complete list.

Funeral & Burial Expenses

Reasonable funeral, burial, and cremation expenses directly attributable to this wrongful death.

Lost Financial Support

The income and financial stability your loved one would have provided for years to come. We project this figure using economic analysis tailored to your family's circumstances.

Loss of Household Services

Childcare, cooking, cleaning, yard work, home repairs. Your loved one's daily contributions to the household are economically measurable.

Loss of Companionship

The loss of love, emotional presence, guidance, and daily companionship. This is often the largest non-economic component of a wrongful death claim.

Pre-Death Pain & Suffering

Through a survival action, damages for the conscious pain your loved one endured before death. Transport to St. John's or Dignity Health in Camarillo often documents this suffering in medical records.

Punitive Damages

When death was caused by a drunk driver, willful act, or extreme negligence, the court can award punitive damages as additional punishment.

How we help

Steps for Wrongful Death Families

Wrongful death claims involve both legal process and profound personal grief. We guide families through both with discretion and determination.

1

Prioritize your family's wellbeing

You have time. The legal process can wait until your family is ready. That is the most important thing right now.

2

Preserve all documentation

Death certificate, CHP reports, St. John's or Dignity Health medical records, and any contact you've received from insurance adjusters.

3

Do not accept any payment or release

Insurers contact families early with offers that don't reflect the full scope of your loss. Don't sign anything before getting legal advice.

4

Document financial dependence

Tax filings, income records, mortgage or rent payments, and documentation of how your household depended on your loved one financially.

What Injury Victims Need to Know

Who can file a wrongful death claim in California?
California CCP §377.60 permits wrongful death claims by surviving spouses or domestic partners, surviving children, and — if there are no surviving spouse/children — persons who would be entitled to the deceased's property by intestate succession (such as parents and siblings). Putative spouses and financially dependent stepchildren may also qualify in some circumstances.
Can I file a wrongful death claim even if there is a criminal case pending?
Yes. Civil wrongful death claims are entirely separate from criminal prosecution and proceed on a different standard of proof (preponderance of the evidence, not beyond a reasonable doubt). The criminal case outcome does not determine your civil claim — and in some cases, a civil claim succeeds even when a criminal case does not.
How long do I have to file a wrongful death claim in California?
Two years from the date of death under CCP §335.1. If a government entity was responsible, a Government Claims Act notice must be filed within six months. Preserving evidence — surveillance footage, event data recorders, witness accounts — is time-sensitive regardless of the legal deadline.
Where does a wrongful death claim from Camarillo get filed?
Wrongful death claims from Camarillo are typically filed in Los Angeles Superior Court or Ventura County Superior Court, depending on where the death-causing incident occurred. Cases arising from accidents on Las Posas Road or in Camarillo generally file in the appropriate local court. L&F Brown handles wrongful death cases throughout both jurisdictions.
